Big Tech’s digital market practices in India are under scrutiny.

Ashok Kumar Gupta, Chairman, Competition Commission of India, said that as India is emerging as one of the largest and fastest growing digital economies, any problems in the digital market should be addressed quickly.

Speaking at the Confederation of Indian Industry (CII)’s annual competition law and practice conference with CCI, Gupta said, “Digital platforms are in a unique position to shape and influence consumers by controlling used data and online real estate.” Choices on one side and consumer traffic to their businesses on the other.

The government has previously said it is scrutinizing the power of big tech companies over digital advertising, fueling speculation that India wants to control its relationship with news publishers.

Earlier this year, the Digital News Publishers Association (DNPA) and the Indian Newspaper Society (INS) approached the Competition Commission of India (CCI) accusing Google of abusing its market dominance.

In March, the antitrust authority decided to block the two lawsuits and ordered an investigation into Google. The INS had written to Google in February last year asking the tech giant to compensate newspapers for content published on its platform. It also wants a bigger share of online advertising revenue.

Concern about competition and competitiveness


The impact of these so-called ‘ecosystems’ is strengthened by the transparency of policies and the benefits of information to both business users and potential competitors, Gupta noted.

“As India emerges as one of the largest and fastest growing digital consumer bases, market distortions need to be corrected quickly. To address the enforcement and policy challenges in this regard, a regulatory framework is needed to harmonize and reflect the complexities of the digital market, classic correction. The commission has been conducting several market studies in various sectors such as e-commerce, telecom and pharmaceuticals among others.

CCI is also setting up a Digital Markets and Data Unit (DMDU) as a knowledge hub to engage with stakeholders, provide inputs on policy issues and support data analysis, he said.

Google court defeat

The General Court of the European Court of Justice has rejected Google’s appeal against an EU antitrust fine for reducing consumer choice by exploiting their dominance in the mobile Android operating system.

Tech giants with pockets of pockets of Google, Amazon, Apple and Meta could challenge the new rules in court, tying up regulators and disrupting the process.

South Korea has also fined Alphabet, Google and the Meta platform tens of millions of dollars for violating privacy laws.

In a statement, the Personal Information Protection Commission said it fined Google 69.2 billion won ($50 million) and Meta 30.8 billion won ($22 million).
