Oil tanker business fined for breach of tank control.


Vermont Business Magazine The Natural Resources Agency’s Department of Environmental Protection (DEC) today announced a $9,000 fine against Fred’s Plumbing & Heating Inc., a fuel oil supply business in Derby, for violating Vermont’s overhead storage tank regulations.

Vermont’s Above Ground Storage Tank (AST) regulations protect human health and the environment by establishing standards for the design, installation and inspection of all AST systems.

For example, AST systems require testing immediately after fuel is delivered to the AST system for the first time. In addition, inspectors are required to post a red tag on any AST system that does not comply with inspection standards, which will prevent oil from reaching non-compliant tanks in the future. Both requirements reduce the possibility of leakage of AST systems if they are incorrect. Vermont law prohibits the dumping of hazardous materials such as gasoline into the environment.

In May 2021, the company did not test the AST system until after the Morristown residence completed its first supply of fuel oil.

Over the next few days, over 100 gallons of fuel oil was released through a pinhole drain in the system into the basement floor drain. Following the spill, remediation efforts resulted in the removal of approximately 48 tons of petroleum-contaminated soil and other materials.

“Decreasing the number of hazardous substances will reduce the risk and impact of petroleum products on human health and the environment,” said DEC Commissioner John Belling. “Proper inspection of AST systems is critical to reducing the number of leaks because inspections can identify problems before they are released.”
